Terms of Service
Welcome to Seektix (“Seektix,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and all associated products and services (collectively, the “Platform”).
By accessing or using Seektix, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, please discontinue use of the Platform immediately.
1. About Seektix
Seektix provides a discovery and aggregation platform that helps users explore events and connect with third-party ticketing providers (the “Ticketing Partners”) such as Ticketmaster, Ticketek, and Eventbrite.
The following important distinctions apply:
- Seektix is not a ticket seller or event organiser.
- We display information provided by third parties and may earn a commission when users make purchases through affiliate links.
- All ticket purchases, event attendance, and related transactions occur directly with the Ticketing Partners or event organisers, not with Seektix.
2. Eligibility
Seektix is open to users of all ages. However, some events listed on the Platform may have age restrictions set by the event organiser or ticketing provider. It is the responsibility of users, parents, or guardians to ensure that attendance and ticket purchases comply with those restrictions.
Users under 13 should only access Seektix with the consent of a parent or guardian. By using Seektix, you confirm that you have the necessary consent and capacity to use the Platform under the laws of your country.
3. Account Registration and Security
Some features require an account created using an email or third-party login (e.g. Google, Facebook, Spotify).
You agree to:
- Provide accurate and current information;
- Keep your credentials secure; and
- Immediately notify Seektix at support@seektix.com if you suspect unauthorised access.
You are responsible for all activities under your account, including those by anyone using your credentials.
4. Permitted Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms.
You must not:
- Access or use the Platform in any way that violates applicable laws or regulations;
- Interfere with, disable, or circumvent any Platform security features;
- Copy, scrape, index, or harvest data without written consent;
- Use automated scripts, crawlers, or bots (except as explicitly permitted via public APIs);
- Impersonate another person or entity;
- Upload content that is defamatory, obscene, unlawful, or infringes others’ rights.
We reserve the right to suspend or terminate access to any user who violates these Terms.
5. Ticketing Partners and Third-Party Services
When you click to purchase a ticket or engage with a third-party service, you will be redirected to a Ticketing Partner or external site.
You acknowledge and agree that:
- Seektix does not control or guarantee the accuracy, pricing, or availability of third-party listings;
- Your purchase, attendance, or refund rights are governed by the terms and conditions of the Ticketing Partner, not Seektix;
- Seektix is not liable for event cancellations, changes, refunds, or disputes with third-party providers.
Any link on Seektix does not imply endorsement or affiliation beyond our disclosed partnership or affiliate relationships.
6. Affiliate Disclosure
Seektix participates in affiliate marketing programs (including via Impact.com) with Ticketmaster, Ticketek, Eventbrite, and other partners.
We may receive a commission if you purchase tickets through links on our Platform.
This compensation does not influence how events are listed, ranked, or displayed.
All affiliate relationships are disclosed in compliance with applicable regulations, including the Australian Competition and Consumer Commission (ACCC) guidelines on affiliate marketing disclosures.
7. Content and Intellectual Property
All intellectual property rights in the Platform—including software, databases, text, graphics, design elements, and logos—are owned by or licensed to Seektix.
You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes only.
You may not:
- Copy, modify, distribute, reproduce, or create derivative works based on the Platform;
- Reverse-engineer or decompile any part of the Platform;
- Use Seektix trademarks, branding, or logos without written consent.
Any rights not expressly granted under these Terms are reserved by Seektix.
8. User Content
If you upload, post, or submit any materials (e.g. comments, reviews, or feedback) through Seektix (“User Content”), you:
- Grant Seektix a worldwide, royalty-free, perpetual, non-exclusive licence to use, display, reproduce, and distribute your content solely for operating and improving the Platform; and
- Represent that you own or have the necessary rights to that content.
Seektix may remove any User Content that violates these Terms or applicable laws, or that we deem inappropriate at our discretion.
9. Data and Privacy
Our Privacy Policy explains how we collect, use, and protect your data.
By using Seektix, you consent to these practices.
If you access Seektix via third-party authentication (Google, Facebook, Spotify), you also authorise us to access limited account data as permitted by each provider’s API.
10. Copyright Complaints
If you believe that any content on Seektix infringes your copyright, please send a written notice to legal@seektix.com including:
- Your contact details;
- Identification of the infringing material;
- Proof of ownership;
- A statement that you have a good-faith belief the use is not authorised.
We will promptly investigate and take appropriate action in accordance with the Copyright Act 1968 (Cth) and applicable international law.
11. Disclaimer of Warranties
To the maximum extent permitted by law:
- The Platform is provided “as is” and “as available.”
- Seektix makes no warranties or representations, express or implied, about the Platform’s availability, reliability, or accuracy.
- We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law (ACL) that cannot be excluded by law.
12. Limitation of Liability
To the fullest extent permitted by law:
- Seektix and its affiliates, officers, employees, or contractors shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data, profits, goodwill, or opportunity) arising out of or related to your use of the Platform.
- Our total aggregate liability for any claim under these Terms shall not exceed AUD $100, or the amount you paid to Seektix in the past 12 months (if any), whichever is greater.
If the ACL applies and Seektix fails to comply with a guarantee, our liability is limited (at our option) to:
- The resupply of the services; or
- The cost of resupplying the services.
13. Indemnity
You agree to indemnify and hold harmless Seektix, its officers, employees, and agents from and against any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Platform;
- Your breach of these Terms; or
- Your infringement of any third-party rights.
14. Termination
You may terminate your account at any time by following the steps described in our Data Deletion Policy.
Seektix may suspend or terminate your account or access to the Platform without notice if we reasonably believe:
- You have breached these Terms;
- Your use presents a security or operational risk; or
- We are required to do so by law.
Upon termination, all rights granted to you under these Terms will cease immediately.
15. Changes to These Terms
We may modify these Terms at any time.
Changes will take effect when posted on this page with an updated “Last Updated” date.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
If a change materially affects your rights, we will provide reasonable notice (e.g. via email or in-app notification).
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia.
You submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia (Melbourne Registry) for any disputes arising from or relating to these Terms.
17. Dispute Resolution
Before commencing formal proceedings, both parties agree to:
- Attempt to resolve any dispute through good-faith negotiations;
- If unresolved within 30 days, either party may refer the matter to mediation in Melbourne, Victoria, administered by the Resolution Institute of Australia under its Mediation Rules.
Nothing in this clause prevents either party from seeking urgent injunctive relief.
18. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy and Data Deletion Policy, constitute the entire agreement between you and Seektix and supersede any prior agreements or understandings relating to the Platform.
